1 Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HornyCompanionAI Inc. ("HornyCompanionAI," "we," "our," or "us") governing your access to and use of the HornyCompanionAI website at hornycompanionai.com, our mobile applications, APIs, and all associated services, features, and content (collectively, the "Platform").

By accessing or using the Platform in any way — including browsing the website, creating an account, or using any feature — you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies or guidelines we post. If you do not agree to these Terms in their entirety, you must immediately cease using the Platform and, if you have created an account, request account deletion.

These Terms supersede all prior agreements between you and HornyCompanionAI regarding the Platform. We reserve the right to update these Terms periodically. See Section 14 for how we notify you of changes and what continued use means for your acceptance of updated Terms.

2 Eligibility

To be eligible to use the Platform, you must: (a) be at least 18 years of age; (b) have the legal capacity to enter into a binding contract in your jurisdiction; (c) not be prohibited from receiving services from HornyCompanionAI under applicable law; and (d) access the Platform only in jurisdictions where doing so is lawful. By using the Platform, you represent and warrant that you meet all eligibility requirements.

It is your sole responsibility to ensure that using this Platform is lawful in your jurisdiction. We do not guarantee that the Platform is available or appropriate in all countries. If you are uncertain about the legality of accessing adult AI content in your location, you should seek legal advice before using the Platform. We will not be liable for any legal consequences you face as a result of accessing the Platform in a jurisdiction where such access is restricted or prohibited.

3 Account Registration

To access most features of the Platform, you must create a registered account. During registration, you agree to provide accurate, current, and complete information. You are prohibited from registering under a false identity, creating accounts on behalf of another person without authorization, or creating multiple accounts to circumvent restrictions applied to a prior account.

You are responsible for maintaining the confidentiality of your account credentials, including your password. You are responsible for all activity that occurs under your account, whether or not you authorized it. If you suspect unauthorized access to your account, you must notify us immediately at support@hornycompanionai.com. We will not be liable for any losses arising from your failure to safeguard your credentials.

You may only create one personal account. Accounts are non-transferable and may not be sold, transferred, or shared with another person. We reserve the right to refuse account registration to any person for any reason, or to require additional verification before activating an account, particularly in relation to age or identity verification requirements.

4 Acceptable Use Policy

You may use the Platform only for its intended purpose — personal, non-commercial, lawful interactions with AI companions — and in a manner consistent with these Terms, our content policies, and all applicable laws and regulations. The following constitutes a non-exhaustive list of prohibited uses. Violating this policy may result in immediate account termination, content removal, and/or legal action.

You agree not to: attempt to reverse engineer, decompile, disassemble, or extract source code from the Platform or its AI systems; use automated scripts, bots, scrapers, or other non-human means to interact with the Platform without our express written permission; attempt to probe, scan, or test the vulnerability of our systems; circumvent, disable, or otherwise interfere with security-related features of the Platform; upload, transmit, or distribute malware, viruses, or any other harmful code; impersonate HornyCompanionAI, its employees, or other users; use the Platform to harass, threaten, or abuse any individual; or use the Platform for any commercial purpose without our prior written consent.

We reserve the right to monitor Platform usage to the extent necessary to enforce these Terms, investigate suspected violations, ensure system security, and comply with legal obligations. Such monitoring will be conducted in accordance with our Privacy Policy and with appropriate data minimization practices.

5 Content and Intellectual Property

The Platform and all of its contents — including but not limited to AI character designs, personalities, backstories, names, visual assets, text, software, code, trademarks, logos, and trade dress — are owned by HornyCompanionAI or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes only.

You may not copy, reproduce, modify, create derivative works from, distribute, publicly display, publicly perform, republish, download, or otherwise exploit any portion of the Platform's content or software without our prior written permission. This prohibition includes but is not limited to: capturing or distributing screenshots or recordings of AI companion conversations; reproducing AI character likenesses; or scraping AI-generated text or images for use outside the Platform.

You retain ownership of any original content you create and submit to the Platform (such as prompts or creative inputs). However, by submitting content to the Platform, you grant HornyCompanionAI a worldwide, royalty-free, non-exclusive license to use, process, and store that content for the sole purpose of providing the Platform's services to you. This license terminates when you delete your account and your data is purged in accordance with our Privacy Policy.

6 AI-Generated Content

The Platform uses artificial intelligence to generate conversational responses, images, voice output, and other content. You acknowledge that AI-generated content is produced algorithmically and does not reflect the views, opinions, or representations of HornyCompanionAI or any real person. AI characters on the Platform are entirely fictional. Any resemblance to real persons, living or deceased, is coincidental and unintentional.

AI-generated content, including conversation responses and AI images, is provided for personal entertainment purposes only. HornyCompanionAI makes no representations or warranties about the accuracy, appropriateness, or completeness of AI-generated content. You use and rely on AI-generated content entirely at your own risk. AI companions are not licensed therapists, medical professionals, legal advisors, or financial advisors — nothing generated by an AI companion should be treated as professional advice of any kind.

HornyCompanionAI retains all intellectual property rights in AI-generated content produced by the Platform, including AI-generated images. Premium subscribers receive a personal, non-commercial license to use AI-generated images for private enjoyment. You may not commercially exploit, publicly distribute, or claim authorship over AI-generated content produced by the Platform.

7 Subscription and Payments

Certain features of the Platform require a paid subscription ("Premium"). By subscribing to Premium, you authorize HornyCompanionAI to charge the applicable subscription fee to your designated payment method on a recurring basis (monthly or annually, as selected) until you cancel. All fees are stated in USD and are exclusive of applicable taxes. You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction.

Subscription fees are billed in advance at the start of each billing period. If your payment method fails, we will retry the charge over 5 business days and notify you by email. If payment is not successfully collected within this period, your account will be downgraded to the free plan until a valid payment method is provided. You are responsible for keeping your payment information current and accurate.

We reserve the right to modify subscription pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing period. Promotional or discounted pricing may be subject to additional terms communicated at the time of the promotion. Feature inclusions and limits in each subscription tier are described on our pricing page and may be updated periodically with reasonable notice.

8 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation is effective at the end of the current billing period; you will retain full Premium access until that date and will not be charged for the next billing period. Cancellation is not retroactive — we do not provide partial-period refunds for monthly subscriptions when you cancel mid-period.

For annual subscriptions, you are eligible for a full refund if you cancel within 14 days of the initial annual payment and have sent fewer than 100 messages through the Platform during that period. This grace period refund can be requested by emailing billing@hornycompanionai.com within the 14-day window. Annual subscription renewals are not refundable after the renewal date has passed.

If you believe you have been charged in error or have experienced a billing issue, contact billing@hornycompanionai.com within 60 days of the charge. We will investigate all billing disputes in good faith and, where an error is confirmed on our part, will provide an appropriate refund or credit. We reserve the right to deny refund requests that we determine are being made in bad faith or that represent misuse of our refund policy.

9 Privacy and Data

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and handling of your information as described in the Privacy Policy. We strongly encourage you to read the Privacy Policy in full before using the Platform, as it contains important information about your rights and our data practices.

The Platform's persistent memory system stores information from your conversations with AI companions to enable the relationship continuity that is central to our service. You have the right to access, modify, and delete your stored memory data at any time through your account settings. You can also request complete account deletion, which will result in permanent removal of all your personal data within 30 days, in accordance with the Privacy Policy.

10 Disclaimers and Limitations of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HORNYCOMPANIONAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. In such jurisdictions, the above limitations and exclusions will apply to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence or for fraud.

11 Prohibited Content

The following categories of content are absolutely prohibited on the Platform, in all contexts, including in conversations, user-submitted prompts, image generation requests, and any other form of interaction. Violations will result in immediate, permanent account termination and may be reported to relevant law enforcement authorities:

• Child Sexual Abuse Material (CSAM): Any content — real, simulated, described, or generated — that sexualizes individuals under the age of 18. This is a zero-tolerance policy and will be reported to authorities.
• Non-Consensual Content: Realistic depictions or descriptions of sexual acts presented as non-consensual in an approving, celebratory, or instructional manner, or content designed to simulate real non-consensual acts involving real individuals.
• Real Person Sexualization: Creating sexual content depicting identifiable real, non-consenting individuals, including public figures, without their explicit consent.
• Content Facilitating Real-World Harm: Content designed to facilitate actual violence, stalking, harassment, trafficking, or exploitation of real individuals.
• Illegal Content: Any content that constitutes, facilitates, or promotes criminal activity under applicable law, including but not limited to drug trafficking, weapons trafficking, or financial fraud.
• Doxxing and Personal Information Disclosure: Sharing, requesting, or distributing private personal information about real individuals (addresses, phone numbers, financial information, etc.) without their consent.
• Malicious Code: Submitting, transmitting, or attempting to execute malicious code, exploits, or any content designed to damage or gain unauthorized access to systems.
• Violation of Third-Party Rights: Content that infringes the intellectual property, privacy, or other legal rights of any third party.

HornyCompanionAI reserves the right to determine, in its sole discretion, whether content violates these prohibitions or any other applicable policy. Decisions to remove content or terminate accounts for policy violations are final, though users may contact support to appeal a decision they believe was made in error.

12 Termination

You may terminate your account at any time by navigating to Account Settings and selecting "Delete Account." Upon deletion, your access to the Platform will be revoked immediately, and your personal data will be deleted within 30 days in accordance with our Privacy Policy. If you have an active paid subscription, it is your responsibility to cancel the subscription before deleting your account to avoid further charges.

HornyCompanionAI reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we determine (in our sole discretion) that you have violated these Terms, our content policies, or any applicable law; engaged in fraudulent or abusive behavior; or if continued provision of the service to you creates legal, security, or reputational risk for us or other users. In cases of serious violations — particularly those involving prohibited content from Section 11 — termination will be immediate and permanent with no right of appeal.

Upon termination for cause, any licenses granted to you under these Terms are immediately revoked. Provisions of these Terms that by their nature should survive termination — including intellectual property provisions, disclaimers, limitations of liability, and the governing law section — shall survive. We will not provide refunds for the remaining portion of any subscription period when an account is terminated for cause.

13 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you hereby consent to personal jurisdiction in such courts.

Notwithstanding the foregoing, to the extent permitted by applicable law, you agree that any claims arising from your use of the Platform must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding. You waive any right to bring a class action lawsuit or class-wide arbitration against HornyCompanionAI. If this waiver is found unenforceable, then the entirety of the arbitration or class action waiver provision shall be null and void.

For users located in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may apply in addition to or instead of the provisions above. Nothing in these Terms is intended to limit rights you have under applicable mandatory consumer protection law that cannot be excluded by contract.

14 Changes to Terms

We may revise these Terms at any time. For material changes — those that meaningfully affect your rights or obligations — we will provide at least 14 days' advance notice via email to your registered address and a prominent notice on the Platform. The updated Terms will include a new "Last Updated" date. For non-material changes, such as clarifications or corrections that do not alter the substance of the agreement, we will update the "Last Updated" date without advance notification.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you disagree with a material change, your remedy is to discontinue using the Platform and, if you have a paid subscription, to cancel it before the change takes effect. We will honor refund requests for the unused portion of annual subscriptions when a material change is the stated reason for cancellation.

If you have questions about these Terms of Service, need to report a violation, or need to contact us for any legal matter, please use the contact information below. We aim to respond to all general inquiries within 5 business days and to legal or compliance matters within 10 business days.

For CSAM reports and child safety concerns specifically, we also encourage reporting directly to the National Center for Missing and Exploited Children (NCMEC) at cybertipline.org and to your local law enforcement authorities. We take all reports of this nature with the utmost seriousness and cooperate fully with law enforcement in such matters.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and HornyCompanionAI regarding your use of the Platform. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
